    Default Question for you eBayers...

I sold a lot of NES games for $15 (10 games total). Auction stated "as is" since I had no idea if they worked. Come to find out they didn't work. The buyer is pissed (even though the auction clearly stated "as is") and doesn't seem to want to work out a refund with me directly, even though I offered one.

Question is, since I stated "as is" in the auction, does he have any sort of recourse through ebay and paypal? I've never run into this senario before, hence is why I'm asking the question.

    Thanks!

as is means you are not responsible of whether or not they work...

id take a look at your return policy however, if u allow returns within 7 days that one might sting you - unless its past 7 days lol

I would tell the buyer to clean them with his tears. As is means as is. He sounds a bit retarded. On top of that why would he not want a refund from you. This guy sounds like an idiot.

Yeah, he claims not one of them is working. I've decided not to refund him the money since the auction stated the following:

"These all worked last time I played them (years ago) but I have no means of testing them as of this auction listing. Therefore they are being sold as is."

"AS IS: Auction items are being sold AS IS with no returns."

He had the choice not to bid on them and took a chance when doing so. I'm an honest eBayer with 100% feedback and would have gladly refuned him the money if I listed working items that for some reason failed upon receipt.

    Thanks for the advice fella's

Its his Nes console thats the problem, the old unreliable cartridge connector. Theres no way that all 10 games aren't going to work, unless you've been storing them outside for ten years! You're right not to refund, its not your fault his console needs a new connector.

You always have to go into an "AS-IS" auction assuming that more likely than not you are bidding on junk. With that being said I got a perfectly working Sega CD for 10 bucks off ebay because it was untested/as-is. Sometimes you win, sometimes you don't when it comes to those kinds of auctions, trying to put fault on the seller is not the way to handle it.

No way all the games wouldn't work, his NES cart connector needs changing. Tell him to shut up and put up.

    A follow up on this...

So paypal awards to the cash back to this lady even before I get the games back. Paypal refuses to give me any sort of details as to why they sided with her. She leaves a nasty negative feedback and destroys my 100% (lol, had to happen sooner or later). So I finally get the lot of 10 NES games back and guess what? They all work 100%. I've left her a message asking her to have the negative mutually removed. I also to her I was gonna appeal the case to paypal with video proof. However, paypal seems to heavily favor the buyer so we'll see what happens.

    I hate dishonest people!!!!

    More to come...

I very much doubt you'll get any meaningful response from ebay/paypal, other than some useless standard email. At least the useless buyer sent the games back, so thats something.

yeah, its obviously not your fault if they do work. I was going to suggest telling the buyer how to clean them (alcohol and a q-tip) and see. The buyer should've consulted someone that knew about the NES or electronics before bitching you out. I agree, she is pretty much an asshole.

That said, one time someone sold me a copy of Midnight Resistance in case from Amazon listed as "very good" and when I got it the insert had a huge growth of mold and it smelled like a public toilet. I asked for a partial refund because I just threw the moldy piece of shit case away (but the game was still OK). In retrospect, knowing what I know now, I probably could've cleaned the case, but still, that's just shady business to sell someone a moldy ass case and claim its "very good." Honestly, I would've either cleaned it or thrown it away before selling it to someone considering the condition.

I still don't know why paypal would side with her on an "as-is" auction. Then to further the situation it turns out that they all actually work too? You are definitely right to pursue this. All you'll get out of it is probably a headache and maybe your feedback, but its the principal of it that would make it worthwhile for me.

eBay and PayPal are real dickheads when it comes to choosing sides. WTF is with this whole "seller can't leave negative feedback" bullshit now?
