Yet for people who speak English we have absolutely no issue doing that here by begging for cartridge preorders from day one.
That said, I remember the argument being made that Japanese users making Mario hacks don't want the attention at all to the point that merely linking to some video they upload publicly was considered grounds for banning because what if they get scared and go away forever (probably because one person who got nagged to hell and had bad attitude for starters may have quit). In practice it turns out it's just language barrier as usual and that they simply don't know how to reach people who don't speak Japanese. It's not just homebrew, I'm seeing this with fandoms in general as well (people starting to resort to translators to reply to English posts).
That said, that the Pac-Man source code was released but with the assets changed makes me convinced that lack of ROM release is entirely for legal reasons and nothing else. And that's assuming he doesn't just change his mind.
I honestly cannot understand this obsession that people have with physical releases and all the package; and it's not just that, they need to proudly demonstrate the stuff they bought like it's an archeological discovery or something.
Copyright laws can be scary. I mean, the government needs to watch out for these huge companies, make sure that no one violates their rights. That said, that the Pac-Man source code was released but with the assets changed makes me convinced that lack of ROM release is entirely for legal reasons and nothing else. Curiously, Japan doesn't seem to be afraid or concerned about child pornography, since up until 2014 possessing child pornography wasn't a crime there ( and naturally, this doesn't apply to Hentai - japanese society would surely collapse if that was the case ) or having young men and women killing themselves or dying from overwork at their companies.

That interesting piece explains it all.
(...) It also emboldened other companies to go after fan works: A year later, Nintendo would have a Pokemon doujinshi artist arrested to essentially “make an example” out of them in a similar incident.

So in the end, nothing was released of this at all? Even the relevant tweets and youtube videos have been since removed. I would've gladly bought a copy if they could have made a small print run of carts, or even put the rom up on steam or so. With Darius Burst having had a PC release a few years ago, maybe the rights owner would be interested too, after all they would not need to code anything, just do QA testing and publish it (and, well, ordering repro carts from china).
So sad to see his hard and incredible work not released or preserved for all the Mega Drive fans... :\

Prince of Persia 2 - The Shadow and the Flame Remastered Edition v1.5
Knew this guy would find a way to release it in one way or another, great news.
Do anyone knows if he works now for M2? Because apparently, "the version of Darius on the Genesis Mini is a totally new version ported by the developer M2, and not based on the fan work."
That would be the only explanation..

That's PR bs from people that probably not even know what a "Darius" is.
Kotaku often has stupid articles and correct them after a few days; journalism is not their forte.
This what I think that happened:
- Hidecade developed the port.
- Hidecade even produced tabletop arcade units based on it, specialized JP magazines covered it.
- M2 took notice of this port while researching Darius-related stuff for their Darius Cozmic Collection.
- When SOJ approached them about the MD mini, they reached out Hidecade and made a deal with him.
- M2 had already built a relationship with Taito for the Cozmic Collection, so they just used it now to get Zuntata to review/approve the music and M2 probably tested/debugged it based on their arcade versions knowledge.
I doubt that M2 didn't put their own stuff in this new port though, since that's one of their usual moves. Maybe extra bosses and other options not initially planned by Hidecade.
