    Mad I bought a Nintendo Switch V1, and received an empty box

    Yup. Lol. You had one job, CanadaPost!

    It's a V1, unpatched, with a Zelda case, new joycons. Got it on eBay for 275$ + shipping.
    I live in Canada and international shipping wasn't offered, so I did what I frequently did and shipped to the Delaware warehouse via FishIsFast.com. I live in Canada, Québec so on the east coast too.

    eBay seller 100% delivered the switch, CIB with the Zelda case, as it was delivered to Delaware, according to domestic tracking and also the workers here who received the package provided a picture of the Switch box and case.
    Never had problems with them so far. So I ship it with USPS to Canada as usual and check on the international tracking.

    Today, a delivery is done, with the usual mailman and WOW, they shipped an empty box !!! They shipped the $20 case and kept the $250 Switch !!! (That'd be around ~350$ CAD.....)
    Wow, just wow. You had one job CanadaPost / USPS !!! x( Bahaha.

    Now, who did it, we'll never know. Let's just say seller dodged a bullet because we have photo evidence he DID shipped the console successfully to the warehouse (Also, this is not a complain against the company itself. It's a good company, but until we know who did this........ we'll never know for sure heh, I blame customs).

    I did put $250 USD on declared value and did paid like $15 extra for full insurrance, "FastClaim" via FishIsFast.com, which should work according to their terms (Now, will I get refunded my $50 shipping fees, probably not. I believe I would have if nothing was delivered, but not partial. Soooo because I received a 20$ case, I might lose that money lol damn. Whoever stole it knew the loopholes huh, it's tracked, but it can't track an empty box). The package was way too light upon reception so I did videotaped the unboxing too =|

    Now FishIsFast requested "as per our related department reply , you need to file a damage report with your local post office and only then if this is done we can open a FastClaim, without that damage report form, we can’t open a claim case. Thank you". When I went to CanadaPost, they were clueless, "I can't do anything", call customer care (wow, great customer service right there, you really care about STOLEN packages...), which I did, and they laboriously provided me with a ticket number, which I wrote down, apparently I should have an email soon, but without having provided an email adress lol how, idk, they do have the tracking number. Let's hope for the best I suppose, if I need to call the post office manager and get a signed form, anything, that might have to do. Sometimes, they put so many conditions, it's easy to wonder if they'll find any way to invalidate your insurrance claim to save money.

    According to CanadaPost (website), only the sender (that's be FishIsFast forwarder) can open a claim for missing items (shouldn't that be the other way around? I've heard of horror stories, sellers getting scammed frequently. Still sucks) : https://www.canadapost-postescanada....rrived-damaged

    Seems like a loophole, I have insurrance but if CanadaPost/FishIsFast refuse to file this claim, I'm in trouble =') I have never used their insurrance service before. And obviously PayPal wouldn't do anything either because the seller did his job correctly, I don't blame him hehe.

    Sooo let's see now what happens. =|

    I guess I'll have to stare at my "LEGO Harry Potter" + "LEGO Incredibles" + "Let's Go Eevee" boxes for much longer.......

    Did seller also videotape him placing the item in the box and shipping it? Crazy how blatantly people just steal packages now.

    Seller did not, but we know he delivered, because it was shipped to an intermediate, forwarding company FishIsFast, in Delaware, which shipped back to me in Canada. I've been using this company since years and it's the first time I have a problem (We don't know who stole. FishIsFast? USPS? CanadaPost? Customs? All of them could be options)
    FishIsFast took this photo, as they do for every package (obviously they don't have time to videotape everything, it's their job to pack), so seller definitely did his job, so I can't complain (plus, even if I tried, that would be a dick move and that wouldn't be fair to the honnest seller). Let's just say he dodged a bullet because we have photo proof that his job was done. All I received was the 20$ case. Lol.

    Sounds like the place in Delaware is the culprit. I mean, they actually pull your stuff out of it's packaging and look at it? That's kind of a bad policy. I wouldn't go for that. I heard when Steam was shipping off it's first Steam Decks, they were labeling on the shipping package what the product actually was inside, leading to a lot of theft in the transit process. Keep the shipping packages nondescript, and keep them unopened. Anything less, just encourages the worst out of people.

    Maybe I'm a bit confused by what you said, but nobody should be seeing the actual product that's being sent to you, anywhere along the way in transit. IMO.

    They could be yes, and your point is totally understandable. They unpack & repack/consolidate everything, multiple packages in 1 box if requested, so that it has the best fit and save fees. At least that's what they'll tell you. This is my 7th order from them since May 2021, and I've never had issues but this is going to be a circus. I can already tell they'll slow down on replies and choke. As I mentionned above and provided links, according to Canada Post and both USPS, sender is the one filling a damage/loss report (which is terrible IMO, my hands are tied), if they refuse to do so, they'll laugh it off, anything to prevent insurance paying me back. It can work perfectly, until ONE thing go wrong and then you see their true colors. Lol.

    I gave Canada Post a few calls and the guy was more useful, I was told they had other ressources than a claim, this time I did got a ticket number by email and will be able to provide unboxing video proof and such (if there wasn't COVID, normally I would have had to fetch the package and open it at the post office in front of the agents most likely. Now, would they have believed me? Yikes).

    I will be filling a police report, at least report it, no way in hell they'll find the asshole who did it but if it can put more pressure on Canada Post, the better IMO. Do US/Canada customs actually open them (it was written "Game Console" with it's actual value on the box) ?

    However, the problem with nondescript, is customs, they need that custom declaration, otherwise any warranty would be cancelled (I don't know about others companies policies but that's that for FishIsFast). Legally, we're suppose to declare everything in the packages. I wrote "Game Console", but didn't dared to write "Nintendo Switch".

    At least, nobody stole my Nomad I bought last year =') (Paid same value lol)

    UPS stole a package of mine recently, indicated by them marking my missing package ticket as "resolved and delivered" the day after I submitted it. Every shipping organization in North America is fucked up, and it's a genuine gamble if you'll ever receive a package. Wasn't the case thirty years ago, but we live in a bad timeline.

    However, the Consumer Protection Act is clear: when you buy online, the responsibility for delivery rests with the merchant, not the courier service or Canada Post.

    Should we take the insurance offered by the courier service, especially for a high value item? Normally, no, since delivery (therefore this protection) is included in the price of the product or the cost of the transaction, especially if you pay for delivery.
    ◆ Do you want to sue Canada Post for lost parcels? Impossible ! Its constitutive act means that it cannot be held responsible.
    ◆ If you have not received your package 30 days after the expected delivery date (for whatever reason), the LPC allows you to demand a refund from the merchant. To file a complaint with the Consumer Protection Office:
    It's a long and tedious process for a complaint, but it could be worth it for 250$ USD. I've never done it but it can work even if the merchant (Shipper, FishIsFast, they offer the shipping service AND the warranty) is international, if he offers service to Québec, I should be protected, I believe. I paid extra for their warranty service and if they refuse to honor it... So far they've been passing the ball along: "Ask CanadaPost for a damage report before we can proceed with the warranty" > "CanadaPost: Only the sender can file a claim". Now I have to wait until Monday for FishIsFast reply and will be waiting for CanadaPost return phone call for their "investigation" as well.

    As I said, I've never done it but I've heard good things about the Consumer Protection Act in Québec. I imagine even a formal notice in the mail and the perspective of taking legal action against FishIsFast could go a long way into scaring the s--t out of them if all fail (you were the last person confirmed with the Switch). I've took all the screenshots I need on their website, according to others, they have a bad history of banning those who complains, with PayPal at least (wtf).

    I mean, I could be totally off-track but that's how I see it. It's worth noting that it's not a LOST parcel, it's an INCOMPLETE/STOLEN package, which is different (and also criminal).

    Already have, but I preferred to not rely on him too much all the time and bother him with shipping stuff - I guess I should've just this one time. =')

    For what it's worth, USPS "Priority Mail International Parcels" includes "up to $200 insurance included" according to the tracking page. If the shipper refuses to honor his $250 warranty thing, USPS might be a 2nd option I imagine.

    In the long run it's just easier to pay a bit more from someone who will ship it out of country rather than relying on a go-between shipping service.

    One eternity later.... (ok, only 2 months HAHA) I received a form from Canada Post a month ago. I filled it and shipped it back to USPS International Ressearch in California. Just today, I got refunded to PayPal including shipping costs, very nice. Ultimately, took 2 months hehe.

    I managed to find another V1 Switch on eBay, will ship directly to Canada now haha.
